Terms of Service

1. Acceptance of Terms

By accessing or using ImgNave (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the Terms, you may not access or use the Service. ImgNave is operated by AINave.

2. Description of Service

ImgNave is a drop-in image optimization layer for Next.js applications. The Service includes:

2.1. An SDK (@imgnave/next) that wraps next.config and a custom loader for next/image, replacing per-transform image billing with a flat monthly base plus CDN bandwidth.

2.2. A managed image pipeline that ingests assets from your /public folder at build time and serves optimized variants (resize, quality negotiation, AVIF/WebP) from a global CDN.

2.3. A dashboard for managing projects, API keys, billing, custom domains, and usage analytics.

3. Accounts and Access

3.1. You must create an account to provision a project, generate API keys, or access the dashboard.

3.2. You are responsible for safeguarding your account credentials and API keys, and for all activity that occurs under them.

3.3. You agree not to disclose your API keys or share project credentials with unauthorized third parties. Compromised keys must be rotated immediately from the dashboard.

3.4. During the pilot phase, access is limited to a finite number of slots. Joining the waitlist does not guarantee a slot.

4. Acceptable Use

4.1. You may use the Service only to deliver image assets associated with web applications you own or are authorized to operate.

4.2. Prohibited content and activities include, but are not limited to:

  • Hosting or delivering illegal, infringing, or fraudulent imagery.
  • Hosting CSAM, non-consensual intimate imagery, or content that violates applicable law.
  • Using the Service as a general-purpose file host, backup target, or hotlinking proxy for third-party assets you do not control.
  • Attempting to circumvent bandwidth allowances, rate limits, or account quotas through scripted abuse, multiple accounts, or other technical means.
  • Reverse engineering, scraping, or attempting to disrupt the integrity or performance of the Service.

4.3. ImgNave reserves the right to suspend or terminate accounts that violate these Terms, with or without notice depending on severity.

5. Pricing, Billing, and Overages

5.1. ImgNave bills a fixed monthly base price per project, plus CDN bandwidth measured in gigabytes once the included allowance is exceeded. The current rates are listed on the pricing section of our marketing site and within your dashboard.

5.2. Image transformations are not metered. Resize, quality negotiation, AVIF/WebP variants, and other on-the-fly transforms are included in the base price.

5.3. CDN bandwidth overages are calculated in real time and reflected on your invoice the following billing cycle.

5.4. Pricing may change. Material pricing changes will be communicated at least 30 days in advance via email to the account owner.

6. Service Levels and Availability

6.1. ImgNave delivers assets via BunnyCDN's global edge network. While we target high availability, the Service is provided on an "as-is" basis during the pilot and we do not offer a contractual SLA at this time.

6.2. Planned maintenance windows will be communicated when possible. Unplanned incidents will be posted to a public status page once one is launched.

7. Your Content

7.1. You retain all ownership rights to the images and assets you upload to the Service.

7.2. By uploading content, you grant ImgNave a worldwide, non-exclusive, royalty-free license to store, transform, cache, and deliver those assets solely as required to operate the Service on your behalf.

7.3. You are responsible for ensuring you hold the rights to the images you upload and that delivery of those images complies with applicable law and the rights of third parties.

8. Removing the Service

8.1. ImgNave is reversible by design. Removing the withImgnave wrapper from your next.config and uninstalling @imgnave/next returns your project to its prior next/image behavior.

8.2. Upon account closure, your stored assets are retained for 30 days to facilitate recovery, then permanently deleted. Account billing data is retained per applicable tax and accounting law.

9. Intellectual Property

9.1. The ImgNave name, logo, SDK code, dashboard, and documentation are the intellectual property of AINave. Nothing in these Terms grants you a license to those properties beyond what is necessary to use the Service.

9.2. Feedback you provide may be used by ImgNave to improve the Service without obligation or compensation.

10. Third-Party Services

The Service relies on third-party infrastructure including, but not limited to, BunnyCDN (delivery), Bunny Storage (origin), and Stripe (billing). Your use of the Service is subject to the applicable terms of those providers where they apply.

11. Termination

11.1. You may cancel your subscription at any time from the dashboard. Cancellation takes effect at the end of the current billing cycle.

11.2. ImgNave may suspend or terminate your access immediately for breach of these Terms, abuse of the Service, non-payment, or operation of the Service in a manner inconsistent with its intended use.

11.3. Sections of these Terms that by their nature should survive termination (ownership, liability limits, indemnification) will survive.

12. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

In no event shall ImgNave, AINave, or their directors, employees, partners, agents, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages - including without limitation loss of profits, revenue, data, goodwill, or other intangible losses - arising from your access to, use of, or inability to use the Service. Total cumulative liability for any claim relating to the Service is capped at the amount you paid ImgNave in the twelve months preceding the claim.

14. Data Storage and Security

14.1. Assets and metadata are stored on BunnyCDN and Bunny Storage infrastructure with global replication.

14.2. Account, billing, and audit data are stored on Hetzner infrastructure in Finland chosen to comply with applicable data protection regulations.

14.3. ImgNave implements industry-standard security measures - transport encryption, key rotation, principle-of-least-privilege access - but you are responsible for the secrecy of your account credentials and API keys.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to conflict-of-law provisions. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts in New Delhi, India.

16. Changes to These Terms

ImgNave reserves the right to modify these Terms at any time. Material changes will be communicated at least 10 days in advance via email to the account owner. Continued use of the Service after the effective date of any change constitutes acceptance of the revised Terms.
